Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and 1748 ("we," "us," or "our") regarding your use of the 1748 mobile application (the "App"). By downloading, installing, or using our App, you agree to be bound by these Terms.

Acceptance of Terms

If you do not agree to these Terms, you may not access or use the App. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

Description of Service

1748 is a tennis training application designed to help players improve their game through:

  • Custom rally pattern creation and practice tracking
  • Interactive shot mapping and accuracy analysis
  • Performance analytics and progress monitoring
  • Training session planning and scheduling
  • Comprehensive practice logging and note-taking
  • Daily focus systems and goal tracking

User Eligibility

You must be at least 13 years old to use this App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. Users under 13 should not provide any personal information to us.

User Account and Registration

While the App may function without registration, certain features may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your account information
  • All activities that occur under your account
  • Providing accurate and complete information
  • Promptly updating any changes to your information

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • Impersonate or attempt to impersonate the company, its employees, or other users
  • Use the App to transmit, distribute, or store any harmful, offensive, or inappropriate content
  • Attempt to disable, bypass, or circumvent any security features of the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to collect information about other users without consent

Content and Data

The App allows you to create, store, and manage tennis training data, including:

  • Training patterns and custom rally sequences
  • Performance data and statistics
  • Practice notes and observations
  • Personal fitness and health information

You retain ownership of any content you create or upload. However, you grant us a license to use this data solely for providing and improving the App's functionality.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of 1748 and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

Data Security and Privacy

Third-Party Services

The App may integrate with third-party services for analytics, mapping, or other functionality. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

App Updates and Modifications

We may release updates to the App from time to time, which may include new features, bug fixes, or security improvements. You agree to install updates as they become available. We reserve the right to modify or discontinue the App at any time with or without notice.

Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the App will meet your requirements or be available on an uninterrupted, secure, or error-free basis
  • That any defects in the App will be corrected

Limitation of Liability

To the fullest extent permitted by applicable law, 1748 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use of or inability to use the App
  • Any conduct or content of any third party on the App
  • Unauthorized access, use, or alteration of your data

Indemnification

You agree to defend, indemnify, and hold harmless 1748 from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the App or violation of these Terms.

Health and Safety Disclaimer

The App provides tennis training guidance and fitness tracking features. However:

  • The App is not a substitute for professional medical advice, diagnosis, or treatment
  • Consult with a physician before beginning any fitness program
  • You assume all risks associated with your use of the App for fitness activities
  • We are not responsible for any injuries that may result from following the App's suggestions

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App ceases immediately.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid provision will be deemed modified to the extent necessary to make it valid and enforceable.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.

Entire Agreement

These Terms constitute the entire agreement between you and 1748 regarding the use of the App and supersede all prior and contemporaneous written or oral agreements between you and us.
